Terms and conditions of the Uniceramic.pl online store

§1 Definitions and explanations

  1. Definitions and synonyms used in these regulations mean:

Customer – a natural person or a legal person or an organizational unit without legal personality that makes purchases on the Uniceramic.pl online store website

Regulations – this document constituting the regulations for the Uniceramic.pl store, owned by Orsa Company.

Shop, online shop, service – online shop operated at Uniceramic.pl, where the Customer can make purchases.

Products, merchandise – household items, in particular ceramics, glass, porcelain and other home furnishings presented in the store.

Sales agreement – ​​sales agreement for products presented on uniceramic.pl concluded between the store and the customer

Order – the customer’s will consisting in the intention to conclude a sales contract, containing the quantity and type of goods ordered.

Civil Code – Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended)

Consumer Rights Act – Act of 30 May 2014 on Consumer Rights (Journal of Laws of 2014, item 827)

Act on the provision of services by electronic means – Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws No. 144, item 1204, as amended)

§2 General provisions

  1. These regulations are an integral part of the store's product sales agreement. uniceramic.pl concluded between the Customer and the Store and specifies the rules for using the website uniceramic.pl, rules for making purchases, rules for placing orders and rules for registering and using an account on the website.
  2. These Regulations are the regulations referred to in Art. 8 of the Act on the provision of electronic services.
  3. Uniceramic.pl online store is run by Orsa Company, NIP: 6121424624, with its registered office at ul. Prusa 30, 59-700 Bolesławiec.
  4. The use of the online store is possible provided that the minimum system and technical requirements used by the Customer are met, i.e.: Having a computer or other electronic device with access to the Internet, Connection to the Internet, Having an Internet browser, Having an active electronic mail address (e-mail address). Purchases can be made via the Internet.
  5. Every customer who makes a purchase through the website uniceramic.pl is obliged to read and accept the regulations.
  6. Shop uniceramic.pl does not sell adult products, especially products that require buyers to be of legal age. In the event of the sale of such products, potential Customers who have not reached the age of majority will be informed of this by an appropriate message in the Store.
  7. Purchases in the store uniceramic.pl can be done by registering a customer account in the store panel, without registration, or by logging in to external providers (e.g. Login with Google, Login with Facebook, Login with Instagram and other social media providers).

§3 Shop offer and sales

  1. The subject of sale in the online store uniceramic.pl are primarily ceramic tableware, e.g. mugs, tea mugs, coffee mugs, decorative mugs, mug sets, coffee cups, cups, tea cups, strainer mugs, infuser mugs, travel mugs, bowls, bowls, soup bowls, amen bowls, platters, plates, dessert plates, dinner plates, platters, hermetic pots, kettles, teapots, jugs, butter dishes, soap dishes and other ceramic products. Additionally, the shop uniceramic.pl sells glass and porcelain products, i.e. glass glasses, glasses, thermal glasses, porcelain cups, porcelain plates, porcelain sets. In addition to the above-mentioned goods, the store also offers other interior design items for houses and apartments, e.g. tablecloths, napkins, lamps, pictures.
  2. Product prices are given for each product, in PLN currency, these are gross amounts including currently applicable tax rates, excluding shipping costs.
  3. Each time an order is placed, a shipping fee is added to the price of the goods.
  4. The goods offered in the store are permitted for sale in Poland and the European Union, as well as other countries to which sales are conducted.
  5. Purchases and orders can be made via the website uniceramic.pl by accepting these regulations.

§4 Rules for using the online store uniceramic.pl

  1. The customer can make purchases without creating an account, they can also create an account on the website by accepting the regulations and providing their personal data, which are marked as mandatory -*- in the form.
  2. Registration is done by filling out and accepting the registration form, available on one of the Store's pages. The condition for registration is to agree to the content of these Regulations and to provide personal data marked as mandatory.
  3. By providing his/her personal data, the client accepts these regulations and consents to the placement of his/her data in the database. uniceramic.pl and processing them in accordance with the Act of 29.09.1997 September 133 on the Protection of Personal Data (Journal of Laws No. 883, item 2016) and the REGULATION (EU) 679/27 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 2016 April 95 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 46/XNUMX/EC (General Data Protection Regulation).
  4. The customer has the option on the website uniceramic.pl agree to receive information about promotions and competitions as well as other commercial information, and has the right to resign from receiving this information at any time by sending a statement of resignation to the store's address: sklep@uniceramic.pl
  5. The Customer undertakes to use the website properly, and in particular to provide true data, without violating the rights of third parties, to use the website in a way that does not disrupt its functioning (e.g. using malicious software, other software or devices that may disrupt the functioning of the store), to use the Online Store in a manner consistent with the provisions of the law in force in the territory of the Republic of Poland, the provisions of the Regulations, as well as the general principles of using the Internet.
  6. In order to ensure the security of transmission of messages and data, the Online Store uniceramic.pl declares that it takes technical and organizational measures appropriate to the level of risk to the security of the services provided, in particular measures to prevent unauthorized persons from obtaining and modifying personal data sent via the Internet.

§5 Making purchases, ordering method, purchase conditions, payment methods

  1. To purchase products in the store uniceramic.pl you should open the website, select the products offered in the store, click the add to cart button and place an order.
  2. Adding products to the basket does not mean reserving them for a given customer. The customer declares that he is aware that the products he has added to the basket may (in the event of purchase by another buyer at the same time) become unavailable for sale.
  3. When placing an order – until the button confirming the placement of the Order is pressed – the Customer has the option to make changes to the selection of goods, remove or add items, and change the quantity.
  4. After the Customer has provided all the necessary data when placing an order, a summary of the order will be displayed. The summary of the placed Order will include, among other things, a description of the selected goods or services, the total price, the price of delivery and other prices. 
  5. In order to conclude a sales agreement, i.e. purchase of products, the customer is obliged to accept these regulations and make a payment for the ordered products, using a button leading to payment ("payment" "go to payment", "pay" or another button with a message confirming the placement of the order). Pressing such a button is equivalent to placing an order and the obligation to pay for the ordered products. It is not possible for the Customer to make a purchase without accepting these regulations, regardless of whether purchases are made without registering on the website or with registration on the website.
  6. After the customer makes the payment, a confirmation will be sent to the email address provided by him during the purchase, containing the details of the purchased goods and it is also a confirmation of the placed order. Sending a confirmation of the placed order means that the store uniceramic.pl received and accepted the order for execution.
  7. If the customer places an order and does not make payment within 15 minutes of placing the order, the order is automatically canceled and the concluded sales contract is terminated immediately.
  8. Shop uniceramic.pl declares that it is not possible to temporarily reserve goods for Customers.
  9. The customer can make a payment by choosing one of the following payment methods: payment card, traditional transfer, BLIK, quick transfer, purchase in installments. All payments are made via external IT systems cooperating with Unicreamic.pl. The store reserves the right to temporarily disable some payment methods without informing customers about it.

§6 Delivery

  1. Delivery of goods takes place to the address indicated by the Customer when placing the order.
  2. The order processing time is the time from the moment the order is received in the store system to the transfer of the package to the courier company. The order processing time is usually 24-48 hours. In justified cases (such as a large number of orders, pre-holiday periods, vacation, illness, unplanned random event), this time may be extended, about which customers making purchases will be informed by appropriate messages on the website of the service, or by a separate e-mail message or telephone information.
  3. The order fulfillment time must include the shipping time, available at uniceramic.pl/dostawa/.
  4. Delivery of goods is carried out by: courier companies, including: DPD, Poczta Polska, InPost, InPost Kurier, Orlen Paczka, Orlen Paczka Kurier.
  5. The shipment of ceramics and glass goods via courier companies InPost (InPost Paczkomaty, InPost Kurier) and Orlen (Orlen Paczka, Orlen Kurier, Paczkomaty Orlen) takes place exclusively at the customer's risk, because ceramics and glass are products excluded from insurance in the above-mentioned courier companies. In the event of damage caused during transport by InPost or Orlen, the customer declares that he will not make claims for damage to the ordered goods or for uniceramic.pl nor from InPost and Orlen.
  6. The shipping price list and delivery time are specified in the "delivery" tab on the website uniceramic.pl/dostawa/
  7. Delivery costs are determined individually for each order, depending on the quantity and weight of the products.
  8. Shop uniceramic.pl reserves the right to temporarily exclude certain delivery methods.
  9. At the time of receiving the package, the risk related to the use and possession of the purchased goods is transferred to the Customer. When receiving the goods, the Customer is obliged to check the package, and in particular check whether it has not been damaged during transport. In the event of finding such damage, the store uniceramic.pl recommends taking photographic documentation, which can later constitute evidence of a complaint to the courier company.
  10. The store is not responsible for incorrectly provided personal data when placing an order, which may result in an incorrect shipping address. In such a case, the return shipment will be at the expense of the customer who provided incorrect data.
  11. The customer undertakes to provide correct and true data when completing the order and the shipping form and to bear the shipping costs, including taxes and customs duties.

§7 Packaging

  1. The Store undertakes to provide the best possible protection and packaging of goods in such a way as to avoid, in particular, breakage or damage during transport. 
  2. Goods intended for shipment are packed using cardboard boxes, PP foam, bubble wrap, paper and other shipping materials intended to properly secure the goods.
  3. Fragile goods such as ceramics and glass will be marked accordingly.
  4. The parcel will be sent to the address provided by the Customer.
  5. For large orders uniceramic.pl reserves the right to divide the order into smaller packages and ship more than 1 package within one order, at its own expense, without adding additional costs to the Customer. The Customer will be informed of such a situation by e-mail, text message or telephone information. Dividing packages into smaller parts is possible when the ordered items differ in size and packaging method. Dividing packages is for safe packaging reasons.

§8 Withdrawal from the contract, warranty

  1. Pursuant to art. 27 of the Act of 30 May 2014 on consumer rights (Journal of Laws of 2019, item 134), a consumer who has concluded a distance contract may return the goods within 14 days without giving any reason and without incurring any costs, except for the costs of returning the goods.
  2. The 14-day period is counted from the receipt of the ordered goods by the Customer, i.e. in particular the receipt of the shipment, regardless of whether it was the receipt of one or more packages as part of a single order. In the case of receiving multiple packages as part of a single order, the time of receipt of the last received package as part of a single order is counted.
  3. In order to exercise the right to withdraw from the contract, the customer is obliged to inform the store of their decision to withdraw from this contract by means of an unequivocal statement. This may be a letter sent to the store by e-mail or traditional mail and have a form similar to Annex No. 1 of these regulations.
  4. Withdrawal from the contract and return of goods in the case of a buyer who is not a consumer or an entity referred to in art. 7aa of the Act of 30 May 2014 on consumer rights in the wording from 1.01.2023 January XNUMX are possible only if the goods do not bear traces of use and have not been damaged or destroyed in any way. The returned goods must have the original labels and stickers with which they were delivered.
  5. The customer has the right to withdraw from the contract within 14 days, with the proviso that he or she is liable for any reduction in the value of the returned goods, including due to inappropriate packaging of the return shipment.
  6. In the event of withdrawal from this contract uniceramic.pl returns all payments received from the customer, including the costs of delivering the goods (except for additional costs resulting from your choice of a delivery method other than the cheapest standard delivery method offered by the store). The refund will be made immediately and in any case no later than 14 days from the day on which we received the returned goods. We will make the refund using the same payment methods that were used by the customer when making the payment, unless you have expressly agreed to another solution.
  7. The returned goods must be sent back within 14 days of the date of delivery of the declaration of withdrawal from the contract, in an undamaged condition and not indicating use, with original tags and stickers. The customer is responsible for the reduction in the value of the item resulting from its use in a way other than necessary to determine the nature, characteristics and functioning of the item.
  8. The goods should be sent to the following address: Orsa Company, ul. Prusa 30, 59-700 Bolesławiec, with the note ZWROT UNICERAMIC.PL. The return must include the receipt or invoice issued at the time of purchase.
  9. All taxes, including customs duties, associated with the return of goods are the responsibility of the customer.
  10. In accordance with applicable regulations, returns of goods purchased by companies are not accepted. In the case of sale of goods in trade between entrepreneurs, pursuant to art. 558 § 1 of the Civil Code, the parties exclude the liability of the store under the warranty for defects in the goods, in particular they agree that they shall not be liable for any hidden defects of the item sold, excluding fraudulently concealed defects.
  11. The Store, as a seller, is liable to the Customer who is a consumer within the meaning of Art. 22[1] of the Civil Code, under the warranty for defects to the extent specified in the Civil Code, in particular in Art. 556 and Art. 556[1]-556[3] of the Civil Code.
  12. Complaints arising from the infringement of the Customer's rights guaranteed by law or under these Regulations should be sent to the following address: Orsa Company, ul. Prusa 30, 59-700 Bolesławiec, or to the following address: sklep@uniceramic.pl . The Store undertakes to consider each complaint within 14 days, and if this is not possible, to inform the Customer within this period when the complaint will be considered.
  13. The store declares that it is not the manufacturer of the goods offered. All goods available in the store are covered by warranty. Uniceramic.pl is liable under the warranty for the goods sold, as specified in the act. If the manufacturer's warranty document provides for such a possibility, the Customer may submit their claims under the warranty directly to the manufacturer. All goods offered in the uniceramic.pl store are new and original and free from defects. Goods offered in uniceramic.pl may, but do not have to, have a product grade designation used by manufacturers.
